Copyright Application

Unlike patents and trademarks, no official procedure is necessary to obtain copyright protection.  Copyright protection is secured automatically when the work is created, that is when the work is fixed in a copy (i.e. any material work from which a work can be read or visually perceived, aided or unaided) or phonorecord (e.g. cassette tapes, CDs, or vinyl disks).  Although a work is protected by copyright from its creation, there are several compelling and advisable advantages to copyright registration, including the following:


  • Registration establishes a public record of the copyright claim.
  • Before an infringement suit may be filed in court, registration is necessary for works of U.S. origin.
  • Registration establishes prima facie evidence of the validity of the copyright and the facts stated in the certificate if the copyright is registered within five years of creation.
  • If the copyright is registered prior to an infringement or within three months after creation, the owner may recover statutory damages and attorney's fees in an infringement suit.  Said damages and fees will not be otherwise recoverable.
  • Once registered, a copyright may be filed with the U.S. Customs Service to prevent the importation of infringing copies.
