What Is Mediation?


Mediation is an alternative dispute resolution method to attempt to settle the issues outside of the courtroom in the presence of an impartial third party. The mediator has no stake in the outcome of your case, and discusses your case individually and privately, with you and your lawyer, in hopes of finding common ground between the parties. Often, a mediator will place each party in a separate room, and go back and forth between each room seeking common ground by providing ideas, proposals, or suggestions.


In mediation, your lawyer is your advocate and makes sure everyone knows the law and your case. You, your lawyer, and the mediator will evaluate all offers you receive, and you are never forced to agree to any offer you do not like. If the mediation is successful, you may enter into a “mediated settlement agreement" which, effectively, will end any dispute agreed upon in that mediated settlement agreement; however, such agreement must still meet the requirements of the Texas Family Code to be enforceable and "binding" once signed. 


What is Arbitration?


Like mediation, arbitration is the private adjudication of disputed matters of fact and law that would otherwise be resolved in court.  However, arbitration is most similar to a civil trial and is very different than mediation; however, arbitration has many benefits that a civil trial does not offer: 

 

  • Privacy: Arbitration proceedings occur in private and not in open court.;

 

  • Convenience and Speed of Resolution: Arbitration can be scheduled at the convenience of the parties rather than under the constraints of a crowded court docket.; and 

 

  • Selection of the Arbiter: Unlike being assigned as judge, you have a say in who your arbiter is, and your chosen arbiter can have additional qualifications better suited to hear your case.

In Texas, either party can request that a jury decide the custody of children, the character of the property, or the value of a business. Is Mediation In Texas Confidential?


Mediation is a formal settlement process that is confidential. Confidential means that neither you, your spouse, nor attorneys can use what you say in mediation against your at trial (unless it is discoverable through other means). In fact, a mediator will not discuss with the other party what you've said unless you want the mediator to make what you said to him or her known to that other party. Unless court-ordered, you, your attorney, your opposing party, and their attorney will mutually select a mutually agreed-upon mediator to hear and resolve any outstanding issues in your case.  Mediation is generally non-binding unless you and your spouse enter into a valid mediated settlement agreement.
