What Is A Trademark Opposition? 


Trademark litigation may involve bringing opposition to a pending trademark before the Trademark Trial and Appeal Board (TTAB). Opposition actions involve the attempt to prevent a trademark from being registered that would infringe upon an existing registered trademark and/or would cause confusion to the public. Such actions can be extremely advantageous in that they can prevent the infringement of a mark altogether. What Is A Trademark?


A trademark is a brand name or service mark that includes any word, name, device, or any combination, used or intended to be used to identify and distinguish the goods/services of one seller or provider from those of others, and to indicate the source of the goods/services. For instance, a trademark protects slogans and symbols that identify a business or brand and distinguishes it from others. 


Can A Domain Name Be A Trademark? 


A domain name only as part of a web address does not qualify as source-indicating trademark use. The registration of a domain name with a domain name registrar does not give you any trademark rights; however, a domain name may qualify as a trademark if there is another prominent use of that domain name, apart from the web address, may qualify as trademark use.  Simply, the domain name registrations, without more, will never be eligible for trademark use in interstate commerce.
