What Is a Trade Name?

A trade name is different than a business' legal name. The business' legal name is the name that appears on your business' formation documents, the name under which your business files taxes, and the name of your business for official government purposes.

A trade name serves as the front-facing designation under which a business operates and is known in the marketplace. This may also be referred to as "doing business as" or a "DBA." A trade name acts as the primary identifier for the business, facilitating its branding and distinguishing it from competitors. Whether it's a local coffee shop or a multinational corporation, each business adopts a trade name to establish its identity. This name appears on storefronts, marketing materials, and products, playing a huge role in shaping the public perception of the business. A trade name may be beneficial if the trade name is easier to say and/or remember than your business' legal name or if you need to change the name of your business but do not want to form a new entity.

Importantly, filing a trade name does not create a new business. Rather, it is your business operating under a "nickname."

Protecting Your Trade Name

There are several things you can do to ensure your trade name is protected. One of these ways is choosing a unique trade name. Selecting a distinctive trade name that is not already in use by another business in your industry or region helps protect the trade name you choose. Further, registering your trade name with the United States Patent and Trademark Office (USPTO) can provide legal protection and exclusive rights to use the name within a specific jurisdiction. Additionally, you should regularly monitor the marketplace for unauthorized use of your trade name by competitors or third-parties. If you discover unauthorized use of your trade name, you should take prompt action to enforce your rights. This may include sending cease-and-desist letters, filing litigation, or pursuing other remedies available under trademark law.

Seeking advice from qualified intellectual property attorneys, like the attorneys of Wilson Whitaker Rynell, can help you navigate the complexities of the law and safeguard your trade name effectively.
